Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the services and websites (the "Services") provided by Pausa (the "Company"). By accessing or using the Services, you are agreeing to these Terms and entering into a legally binding contract with Pausa, LLC. Do not access or use the Services if you are unwilling or unable to be bound by the Terms.

Changes to the Terms

We may modify these Terms from time to time. If we do, we'll notify you, either through the Services or through other means. Your continued use of the Services after the modifications have become effective is deemed to be acceptance of those modifications. Therefore, you should review the Terms whenever you use the Services.

Use of the Services

• Eligibility: You must be at least 13 years old to use the Services. By agreeing to these Terms, you represent and warrant to us that you are at least 13 years old.

• Registration: You may need to create an account to use some of our Services. You are responsible for safeguarding your account, so use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

You understand that Pausa´s recommendations, hints, and other produced content based on your annotations is not provided as a professional service (ie. medical, psychological, legal) and therefore you are strongly suggested to seek professional assistance when appropriate.

Content

• Responsibility for Your Content: You are solely responsible for the content you create, upload, post, or otherwise make available through the Services. You assume all risks associated with your content, including any reliance on its accuracy, completeness, or usefulness.

• You agree to avoid including any content that is forbidden by law, including but not limited to content that is defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party, or which may otherwise give rise to liability or violate any law.

• You shall not use the Services to upload content that is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or any material that would violate the rights of others or promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. Additionally, you are prohibited from uploading any content that infringes upon intellectual property rights, violates privacy or publicity rights, encourages criminal conduct, or contains viruses, malicious code, or any other harmful components that could disrupt, damage, or interfere with the proper functioning of the Services or devices of others.

Intellectual Property

The Services and all materials therein, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos and music (the "Pausa Content"), and all Intellectual Property Rights related thereto, are the exclusive property of Pausa and its licensors.

Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Indemnification

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

Billing

• Free Plan: Pausa offers a Free Plan which allows users to access a limited set of features at no cost. No payment information is required to use the Free Plan.

• Premium Plan: For access to additional features, users may subscribe to the Premium Plan at a cost of $10 per month.

  • Subscription Period: The subscription period for the Premium Plan is one month, with the subscription period beginning on the day the user subscribes and automatically renewing each month on the same day of the month, unless canceled by the user.

  • Payment: By subscribing to the Premium Plan, users authorize Pausa to charge the provided payment method $10 each month. It's the user's responsibility to keep their payment information current.

  • Cancellations: Users can cancel their Premium Plan subscription at any time through the account settings. Cancellations will take effect at the end of the current billing period, and no refunds will be issued for partially used periods.

  • Upgrades and Downgrades: Users can upgrade from the Free Plan to the Premium Plan or downgrade from the Premium Plan to the Free Plan at any time. Upgrades will take effect immediately, while downgrades will take effect at the end of the current billing period.

• Billing Disputes: Any billing disputes should be brought to Pausa's attention within 30 days of the charge in question by contacting billing@pausa.com or your support contact.

Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Florida, United States:, without regard to its conflict of law provisions.
